Please read these Terms and Conditions ("Terms") carefully before using the AUTOMER PRO. By using any part of our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between user and AUTOMER PRO, governing your access to and use of our website, mobile application, and all related services (collectively, the "Platform").

By accessing or using the Platform, clicking "Sign Up," or completing registration, you agree to these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Definitions

  • "Platform" refers to the AUTOMER PRO website, mobile app, and all associated services.

  • "Job Seeker" means any individual who registers to search and apply for job opportunities.

  • "Employer / Recruiter" means any business or individual who uses the Platform to post jobs or search for candidates.

  • "Content" means any text, data, information, images, resumes, job postings, or other material submitted to or displayed on the Platform.

  • "Premium Services" refers to paid features, subscriptions, or add-on services available on the Platform.

3. Eligibility

To use our Platform, you must:

  • Be at least 18 years of age.

  • Have the legal capacity to enter into a binding contract.

  • Not be prohibited from using our services under the laws of your country or region.

  • Provide accurate, complete, and current registration information.

We reserve the right to refuse service to anyone at our sole discretion.

4. Account Registration

You must create an account by starting the subscription to access most features of our Platform. You agree to:

  • Provide truthful, accurate, and complete information during registration and keep it updated.

  • Maintain the confidentiality of your account credentials and not share your password with any third party.

  • Accept full responsibility for all activity that occurs under your account.

  • Notify us immediately at  if you suspect unauthorized access to your account.

We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. Services Offered

AUTOMER PRO provides an online platform that connects job seekers with employment opportunities. Our services include but are not limited to:

  • Job search and browsing across various industries, roles, and locations.

  • Resume creation, uploading, and sharing with prospective employers.

  • Job application submission through our Platform.

  • Job alerts and notifications based on your preferences.

  • Premium services including featured profile listing, resume review, application boosts, and career coaching.

  • Employer-facing tools for posting jobs, searching candidates, and managing applications.

6. Paid Plans and Billing

Certain features on our Platform require payment. By subscribing to a paid plan or purchasing a service:

  • You authorize us to charge your designated payment method for the amount specified at the time of purchase.

  • All prices are displayed in [INR] and include applicable taxes unless stated otherwise.

  • Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.

  • We reserve the right to modify pricing with reasonable advance notice. Continued use after a price change constitutes acceptance.

  • Failed payments may result in suspension of premium access until the outstanding amount is settled.

All payments are processed through secure third-party payment gateways. We do not store your complete card information. Please refer to our Refund Policy for details on cancellations and refunds.

7. User Conduct and Obligations

You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Provide false, misleading, or fraudulent information in your profile, resume, or any communications.

  • Impersonate any person, organisation, or entity.

  • Post or transmit any content that is defamatory, obscene, discriminatory, harassing, or otherwise unlawful.

  • Use the Platform to spam, solicit, or send unsolicited commercial messages to other users or employers.

  • Attempt to scrape, harvest, or collect data from the Platform using automated tools without our written consent.

  • Interfere with or disrupt the integrity or performance of the Platform or its infrastructure.

  • Attempt to gain unauthorized access to any part of the Platform or another user's account.

  • Use the Platform for any purpose other than genuine job seeking or recruitment.

  • Create multiple accounts or accounts intended to circumvent a suspension or ban.

Violation of these conduct standards may result in immediate suspension or termination of your account without notice or refund.

8. Employer and Recruiter Terms

If you use our Platform as an employer or recruiter, you additionally agree to:

  • Post only genuine, lawful job vacancies with accurate and complete descriptions.

  • Not post jobs that are discriminatory based on caste, religion, gender, age, disability, or any other protected characteristic under applicable law.

  • Use candidate data (resumes, contact details) solely for legitimate recruitment purposes and in compliance with applicable data protection laws.

  • Not share candidate information with unauthorised third parties without the candidate's consent.

  • Pay all applicable fees for employer-side services (job postings, candidate searches, featured listings) as agreed.

  • Comply with all applicable employment laws in your jurisdiction when hiring through our Platform.

9. Intellectual Property

All content on the Platform that is created by AUTOMER PRO — including but not limited to logos, brand assets, software, design, text, and data compilations — is our exclusive intellectual property and is protected by applicable copyright, trademark, and other intellectual property laws.

By submitting content to the Platform (such as your resume, profile information, or reviews), you grant us a non-exclusive, royalty-free, worldwide licence to use, store, display, and process such content solely for the purpose of providing and improving our services.

You may not reproduce, distribute, modify, or create derivative works of our Platform content without our prior written consent.

10. Disclaimers and Limitation of Liability

To the fullest extent permitted by applicable law:

  • We are not responsible for the accuracy, completeness, or legality of any job listing posted by employers.

  • We do not verify employer credentials or the legitimacy of every job posting, though we take reasonable steps to prevent fraudulent listings.

  • We are not liable for any employment decision, hiring outcome, or contractual arrangement between a job seeker and an employer.

  • Our total liability to you for any claim arising out of or related to the use of the Platform shall not exceed the amount you paid us in the 3 months preceding the claim.

  • We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless AUTOMER PRO and its officers, directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you submit to the Platform.

12. Termination

You may delete your account at any time by contacting our support team. Upon deletion, your profile and data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account at any time, with or without notice, if:

  • You breach any provision of these Terms.

  • We are required to do so by applicable law or a regulatory authority.

  • We reasonably believe your account is being used for fraudulent or harmful activity.

Termination does not affect any accrued rights or obligations. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and dispute resolution) shall survive.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [India/Delhi], without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in [Delhi, India], or to the courts of competent jurisdiction in [Delhi/Delhi], as applicable.

You agree to waive any right to a class action lawsuit or class-wide arbitration against us.

14. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page and, for material changes, notify registered users by email or in-app notification at least 14 days before the changes take effect.

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Platform and may request to delete your account.

15. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between user and AUTOMER PRO regarding use of the Platform.

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign ours freely.

  • Force Majeure: We are not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, or internet outages.

Important:

  • We act solely as an intermediary connecting job seekers and employers. We do not guarantee employment, interviews, or any specific outcome from using our Platform. The final hiring decision rests entirely with the employer.

  • The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Platform will be error-free, uninterrupted, or free of viruses or other harmful components.
